STATUTES AND REGULATIONS OF THE SECTORIAL COMMITTEE: THE WATER OBSERVATORY

GENERAL

Section 1. NATURE AND SCOPE OF ACTIVITIES

1.1 The Water Observatory (hereinafter Observatory), is a collegial body of participation of the Javea Town Hall, of a consultative, informative, advisory and recommendatory nature and for the promotion of initiatives relating to the supply, sanitation, purification and reuse of water in the municipality

1.2 The scope of this Observatory corresponds to the municipality of Xàbia.

Article 2. organizational affiliation
Without prejudice to their functional independence, the Observatory is integrated into local government bodies responsible for the integrated water cycle, which will provide technical support and the necessary structure for operation.

Article 3 HEADQUARTERS
The Centre shall have its headquarters in the Board Room of the Desalination Plant Seawater Xàbia, located in Senia Vella.

Article 4 FUNCTIONS
a) Put forward suggestions, initiatives and proposals for solving the problem.
b) Collect citizens' views on any matters for which they receive the advice or opinion of the corresponding governing body.
c) Report action programs or budgets thereof.
d) Promote the development of studies and research on the integrated water cycle, and to identify needs.
e) To follow up the agreements adopted by competent government bodies on proposals made by the Observatory
f) To ensure compliance.

Article 5. COMPOSITION AND STRUCTURE
The Observatory will work in plenary session and with a Governing Board.
The Observatory will consist of:
1) President: Mayor or his delegated Councillor
2) VP: A Councillor appointed by the Mayor.
3) Secretary: Will be appointed by the President among staff officer of the Town Hall
4) Members: whose composition is as below

PLENARY SESSION:
Composed of the President, Vice President, Secretary and members detailed below.
It will have four sections of Representation:

1. Municipal Sector Representation.
a) 1 representative of each municipal group.
b) 1 Representative of the Board of Amjasa.

2. Public Sector Representation.
a) 3 Representatives of neighbors and citizens, corresponding to the three urban centres of the municipality: Pueblo-Puerto-Arenal.
b) 3 representatives of communities and associations of urbanisations and dispersed communities
c) 1 Representative of the consumer organization.
d) 1 Representative of the Association of Housewives, Consumers and Users of Xàbia

3. Professional Sector Representation.
a) Representatives of professional water sector.
a.1) 1 Representative of professional associations with links with water: plumbers, gardeners, Swimming pool maintenance, etc.
a.2) 1 Representative Amjasa workers.

b) Representatives of merchants, restaurateurs and hoteliers.
b.1) 1 Representative from trade associations.
b.2) 1 Representative of the Hospitality Association.
b.3) 1 Representative of the association of hoteliers.

c) Representatives of the Agricultural Sector.
c.1) 1 Representative of the Community of Irrigators of Javea.
c.2) 1 Representative of farmers' associations.

d) Representatives of the industrial sector.
d.1) 1 Representative of industry associations.
d.2) 1 Representative of the Fishermen's Association.

4. Educational Sector Representation.
a) Representatives of the educational community.
a.1) 1 Representative of the universities.
a.2) 1 Representative of the Xàbia institutes.
a.3) 1 Representative of the schools in Javea.
a.4) 1 Representative of the Consell dels Xiquets.

GOVERNING BOARD:
Composed of the President, Vice President, Secretary and members detailed below.
It will have a maximum of five members:
a) 3 members from the first three sectors.
b) 2 members of the education sector.

Article 6 FUNCTIONS OF THE PRESIDENT
a) To preside and coordinate the activities of the Observatory
b) Set the agenda, convene and moderate the plenary meetings, and the Board
c) To authorize with his signature acts and certifications of the agreements of the collegiate bodies.
d) To ensure compliance with the aims of the Observatory
e) Represent the Observatory
f) To propose the creation of study groups

Article 7 FUNCTIONS OF THE VICE PRESIDENT
Be appointed by the Mayor, among councilors, a vice president who will occupy the Presidency of the Observatory in the absence of the President and in cases of vacancy, until the appointment of a new President occurs. The Vice President also exercise the functions delegated by the President.

Article 8 FUNCTIONS OF THE PLENARY SESSION
a) Present initiatives, suggestions and proposals.
b) jointly propose solutions to problems in the sector.
c) Collaborate in studies and development of programs and projects.
d) To advise on the development of programs of action and budget.
e) Inform the City Council when requested.
f) To approve the Annual Report.
g) To appoint the members of the Governing Board.

Article 9. Functions of the Governing Board
a) Develop the work entrusted by the Plenary of the Observatory
b) Present and promote Plenary policy initiatives

Article 10. RENEWAL OF THE OBSERVATORY
The composition is renewed after the holding of municipal elections and once constituted, the resulting Corporation.

Article 11.- LOSS OF MEMBERSHIP OF THE OBSERVATORY.
Members of the Observatory remain in office until their termination or loss occurs condition, which may be:
a) Resignation
b) disqualification from public office declared by court ruling
c) Death
d) conviction of a felony
e) repeated failure to attend meetings of the Observatory
f) loss of membership of the Corporation
g) revocation of the proposal of his appointment
h) Any other cause legally established.

Where appropriate, representatives will be dismissed as such by a proposal from the organization which appointed them, and must within one month, formulate proposal for a new appointment.

Article 12.- FUNCTIONING OF THE PLENARY SESSION.
1. The Plenum of the Observatory shall meet at least once every six months in ordinary session. By way of extraordinary will meet whenever it is deemed necessary, by a proposal from the President or one third of the members.
2. The ordinary call will be made with a minimum of three working days. An Extraordinary, properly convened meeting may be called within 24 hours.
3. The Plenary session of the Observatory is constituted when the absolute majority of its members are present on first call or on the second call, half an hour later by the members present, which may not be less than five.
4. Plenary sessions of the Observatory are public and open in nature, and anyone who wants to attend may do so.

Article 13.- FUNCTIONING OF THE Governing Board.
1.- meet in ordinary or extraordinary session whenever the President deems necessary or requested by one third of the members.
2. The rate of call will be the same set out in paragraph 2 of the previous article.
3. The Governing Board shall be deemed constituted when the absolute majority are present in first call. On the second call thirty minutes later, it may be constituted regardless of the number of assistants.

Article 14. RIGHTS AND DUTIES OF MEMBERS OF THE OBSERVATORY.
1. The rights of the members of the Observatory:
a) To seek, through the Chairman of the Observatory, data and documents necessary for the exercise of their duties.
b) Access to documentation and gathering reports or studies on topics which are being developed.
c) To submit motions and suggestions
d) To participate with voice and vote at meetings of the Observatory

2. The duties of the members of the Observatory:
a) Attend meetings of bodies forming part of it.
b) keep secret matters which are specifically identified and the deliberations of the organs forming part of it.
c) To participate in the work for which they are designated.
